So first, I’m just going to go over the statute here, and it’s codified under Title 21 of the Oklahoma Statutes, Section 1435, which actually talks about second and third degree burglary. Today we’re going to talk about second.
Second degree burglary is defined as every person who breaks and enters the dwelling of another in which there is at that time no human being present, or any commercial building or any part of any building, room, booth, tent, railroad car, or other structure in which any property is kept or breaks into or forcibly opens any coin-operated or vending machine or device with intent to steal any property therein or to commit any felony is guilty of burglary in second degree.
The reason I go through that whole definition is because you can kind of see second degree burglary is really a catch-all. It covers breaking into homes, commercial buildings, rooms, booths, tents, structures, and even vending machines. It encompasses any situation where you break in with the intent to steal something and that place is not occupied by a person.
It’s important to note that second degree burglary is a felony offense in Oklahoma, and if convicted, you can be sentenced up to seven years in the Department of Corrections.
