Third degree burglary, it’s actually one that I think less people are aware of. You hear of first and second degree more often. But there is a statute for third degree burglary. It is also a felony, and it does carry serious prison time if you’re convicted of it.
So what is third degree burglary? Well, I’m gonna read from the statute here, and it’s codified in Title 21 of the Oklahoma Statutes, Section 1435, which is also the same section you find second degree burglary. So third degree burglary is under subsection B of that statute, and it reads, every person who breaks and enters, climbs under, or uses any jack stands or any other item to raise an automobile, truck, trailer, or vessel of another in which any property is kept with intent to, one, steal the property therein, two, steal any property attached thereto, or three, commit any felony as guilty of burglary in the third degree.
So what that means is, yes, breaking into an automobile to steal a radio or a change or whatever inside, also lifting up an automobile to steal the wheels or tires, the catalytic converter, something of that nature. Those all fall under third degree burglary. And in fact, actually, if you go down to subsection C there, they go on to further define that property attached thereto does include tires, wheels, and catalytic converters. So there we go.
Potential Consequences for Third Degree Burglary
Again, an important crime, I think something people don’t always associate with a major felony crime in Oklahoma, but we need to know that if you are convicted of third degree burglary in Oklahoma, you can be sentenced up to five years in the Department of Corrections. So again, really is a major thing.
