Navigating Lingering Charges and Warrants
Do you have a lingering charge or warrant from your past? Hi, I’m Oklahoma State Attorney Aaron Easton and today I want to talk about that topic because it’s something that we come across quite often actually and I want to talk about it in the context of a recent success story we had with a client of ours.
So a few months back we had a client come to us who had learned that he had a warrant out for his arrest for a crime that the state believes he committed and it was about four years old and this gentleman just had no idea it was out there and somehow he came across it, a background check, a thing of that nature, and he came to our firm wanting to know what to do.
And for his particular case what we decided to do was to motion the court to end up to dismiss his case for the want of a speedy trial. Under the United States Constitution all of us have a right to a speedy trial if we’re tried for a crime, if the state believes we committed some crime, we have a right to be heard and to be heard speedily. Now there are several factors that go into whether or not you might be a candidate for that but this gentleman as I mentioned came in, we worked with him, this was an Oklahoma County case for a felony crime and we were able to motion the court for that, work with the district attorney who ended up not fighting us on the matter, sometimes they do, sometimes they don’t, and we entered an aggrieved motion and got his case dismissed.
How We Can Help You
So this cloud that was lingering over his head, A, he didn’t know it was there at first and then it was just this scary proposition, they had this pending felony, we were able to get it dismissed, he never had to step foot in court and he obviously went home a happy customer.
So if this situation sounds like something that you’re dealing with right now, you’re going to want to speak to an attorney about the specifics of your case and you’re going to want to do so privately and confidentially.
