Parole Eligibility
Hi, I’m Oklahoma City Attorney Aaron Easton and that’s the topic we have for us today. So an 85% crime refers to the percentage of a sentence you have to serve before you’re eligible for parole.
In Oklahoma, there are a handful of crimes, in fact there are 22 crimes, that fall under a statute that governs the types of sentences that you can’t get out on parole for unless you’ve served 85% of that sentence. And we can find those crimes listed in Title 21 of the Oklahoma Statutes, Section 13.1, and I’m not going to read through all of these, but they’re crimes such as first or second degree murder, manslaughter, shooting with an intent to kill, assault with intent to kill, robbery crimes, rape, arson, some of the major felony crimes that you might expect.
So what it is actually is it’s a limitation on the credit you can earn once you get a sentence. So again, if you’re sentenced to one of those crimes, you have to serve at least 85% before you can go up in front of the Pardon and Parole Board to seek parole.
