85% Crimes
Have you been sentenced to an 85% crime in Oklahoma? Hi, I’m Oklahoma City Attorney Aaron Easton and if so, you’re going to want to hear the information in this video because the knowledge that you were being tried for an 85% crime is actually really important.
So in Oklahoma, 85% crimes are those crimes that you have to serve 85% of your sentence before you’re eligible for parole. And the Oklahoma Court of Criminal Appeals has said that if you are tried for that type of crime, you have to have knowledge of the type of sentence that carries. And that can be one of two things.
So if you go to a jury trial, there’s a specific jury instruction that the jury has to know that the crime that they are deliberating on whether or not to convict you and what to sentence you of, they have to know that that is an 85% crime. On the flip side of that, if you’ve taken a plea bargain with the state for the crime that you’ve been charged with and it’s an 85% crime but you weren’t properly notified of that, very importantly the Court of Criminal Appeals has said that you may have had the ineffective assistance of counsel. And so you could actually go back and attempt to have that conviction retried because the fact that you pled to a crime that you didn’t have the knowledge of was an 85% crime.
