First Degree Burglary

So first off, I just want to read through the elements of the crime. It’s a pretty short statute, and then we’ll talk a little bit about some of the things that are noteworthy in there.
So first-degree burglary is defined as every person, and I should back up one, it’s Title 21, Section 1431, and it says every person who breaks into and enters the dwelling house of another, and this is an important part, and which there is at that time some human being, so there’s somebody inside the house, with intent to commit some crime therein, either by forcibly busting or breaking the wall or an outer door, window, or shutter, by breaking in any other manner while being armed with a dangerous weapon, or by unlocking an outer door by means of false keys, picking a lock, or by lifting a latch or opening a window is guilty of burglary in the first degree.
So as you can see, there are a lot of different ways in which you could break into the home, almost any way you can envision, would qualify under that statute as the breaking part. Again, so essentially you’re breaking into a home, under any of those means, with the intent to commit a crime inside, and there’s a person inside.
Understanding the Severity of First Degree Burglary
Those are the elements of burglary, but one of the things that I really want to point out there is it is actually codified under the Oklahoma statute that defines 85% crimes, and that means that if you are tried for and convicted of first degree burglary in Oklahoma, you would have to serve 85% of that sentence prior to being eligible for parole, and importantly, the sentencing range for first degree burglary can go up to 20 years. So again, really important crime.
